In 2013, a case related to the teacher-record holder’s absenteeism was referred to the Ministry of Education by the director of his school for investigation. When the teacher was absent for a long period of time and worked for four months, the headmistress received many complaints from the students. Among other things, they alleged that they were not prepared for the subjects and gave random marks.
A ministerial inspection in 2013 showed absenteeism and numerous errors in teacher behavior and work methods that were deemed “contrary to teaching principles”; Because she was not paying attention to what was happening in class and was using her cell phone too much.
As a result, the ministry decided to issue a disciplinary dismissal, but the woman appealed and claimed the right to continue teaching and her “freedom”.
He won at first instance, but the Court of Appeal upheld the dismissal decision two years ago. This decision has now been confirmed by the Supreme Court. As he reasoned, the freedom to teach does not mean that “the teacher has the right not to use any method or to organize and plan the course of the lesson”.
